O presente artigo propõe analisar os princípios bioéticos e a possibilidade de sua aplicação no âmbito do Biodireito. Mais especificamente, após um breve panorama da teoria dos princípios na seara jurídica, abarcando as principais evoluções doutrinárias, foca-se nos princípios da Bioética estruturados pelo Principialismo, que apresenta os princípios básicos para o agir humano frente a uma moralidade comum, abordando-se tanto os seus fundamentos que consagraram o uso dos princípios nos dilemas bioéticos, quanto as críticas sofridas que resultaram em nova proposta (...) de estrutura principiológica. Finalmente, se discute o contexto dessa nova proposta de princípios bioéticos fundada na Europa, que fortalece a preocupação com a coexistência entre o ser humano e os demais seres vivos que colaboram com o equilíbrio da vida, bem como a sua possível aplicação ao Biodireito, como salvaguarda da dignidade dos seres humanos nas questões éticas e jurídicas criadas pelos avanços biotecnológicos. Introduction The influence of family factors on the academic performance of nursing students in group B of the University Foundation of the Andean Area 2022 was characterized. Methodology: This is a descriptive, quantitative and cross-sectional study. Non-random sample of 50 students. Results: The results of this research show that there is a significant relationship between the Family Social Climate and the School Performance of fourth-semester students, group B, of the Nursing program of the University Foundation of the Andean Area Pereira (...) Sectional in the second semester of 2022. It is concluded that the Low Academic Performance demonstrated by the students of the Institution in the year 2022 is related to the inadequate Family Social Climate in which the students live. Conclusion: Families do not identify high family risk even with adverse conditions such as weakness with the social support network. It is necessary to intensify actions that involve the health of the family. (shrink)

Este artículo presenta una reflexión respecto a la dimensión política de quienes ejercemos la labor bibliotecaria o bibliotecológica, enmarcada en la educación inclusiva del Sur Global, donde se parte del reconocimiento de la labor bibliotecaria y bibliotecológica asociada, generalmente, con un conocimiento práctico de las cosas o techné, debido a las condiciones históricas en que la disciplina científica se consolidó como tal. Empero, cada vez más se hace necesario que esta labor se proyecte de manera consciente y decidida hacia el (...) afianzamiento de la bibliotecología como campo de conocimiento necesario y útil para el logro de los principios sociales de la democracia, la justicia social y los derechos humanos; reconociendo, así, su dimensión política. Inicialmente se presenta una introducción histórica a la bibliotecología como ciencia. Después, se expone el significado sobre ser bibliotecario en Latinoamérica a la luz de las funciones sociales de la biblioteca y la bibliotecología. A continuación, se interpela la necesidad de que quien ejerce la labor bibliotecaria debe ser un sujeto político, incluso a pesar de sí mismo. Como preámbulo al cierre se presentan, a través de casos específicos y manifestaciones de acción social comunitaria, ejemplos de la dimensión política del bibliotecario. Finalmente, se cierra con una serie de propuestas y desafíos para trabajar en el fortalecimiento de una práctica política en la labor bibliotecaria o bibliotecológica en el Sur Global. (shrink)

La pregunta por el sentido general del ser emerge, en situaciones críticas, como una indagación noética y existencial que descubre la condición finita y vulnerable del ser ahí. La pandemia Covid19 se ha convertido en el contexto social la oportunidad para pensar en la importancia del cuidado en donde, a raíz del confinamiento y el aislamiento preventivo, se ha modificado de forma infranqueable los ritmos de vida. La rapidación del mundo social de producción y consumo ha constituido el modus vivendi-operandi (...) de nuestras sociedades capitalistas. Por eso, los ritmos de vida acelerados han constituido la forma habitual del ser ahí en la carrera social hacia el éxito, consumada en una vida aparentemente feliz, sujeta a las tendencias del mercado y convirtiéndose, este imaginario colectivo, en el paradigma globalizado al cual aspira cualquier persona desde el nivel de vida o estrato social en que se encuentra. Los relegados del sistema, por su parte, quiénes no están a la altura de la competencia del capitalismo salvaje, se convierten en excedentes sociales postergados hacia el inevitable destino del desecho. Si queremos reivindicar el discurso del ser es en orden al fortalecimiento del cuidado de la vida, como un asunto primordial del ser ahí, para reconocer la raíz humana de la crisis ecológica porque, a la base de esta indagación fundamental se encuentra una deficiente cultura del cuidado que no es otra cosa que el descuido mismo del ser. El objetivo de este artículo, derivado de un proceso de investigación documental, es proponer, a la luz de los aportes de Martín Heidegger, la estructura fundamental de la cura como elemento consustancial de la vida en orden al cuidado de sí, de los otros y del ambiente natural como una respuesta oportuna a la crisis actual. I evaluate the adequacy of the three models of international business ethics that have been recently proposed by Thomas Donald son, Gerard Elfstrom and Richard De George. Using the example of the conduct of the aluminum companies in Jamaica, I argue that these three models fail to address the most important of the ethical issues encountered by multinationals because they focus too narrowly on human rights issues and on utilitarian considerations. In addition I argue that these models also evidence an (...) inadequate understanding of microeconomic theory. I end by proposing that these defects can be remedied by a model of ethics that incorporates a theory of moral rights, a utilitarian-based theory of the market, and a theory of justice. (shrink)

This article describes Catholic natural law tradition by examining its origins in the medieval penitentials, the papal decretals, the writings of Thomas Aquinas, and seventeenth-century casuistry. Catholic natural law emerges as a flexible ethic that conceives of human nature as rational and as oriented to certain basic goods that ought to be pursued and whose pursuit is made possible by the virtues. Four approaches to natural law that have evolved within the United States during the twentieth century are then identified, (...) including the traditionalist, proportionalist, right reason, and historicist approaches. The normative implications of these approaches are discussed in relation to ethical issues in the tobacco industry, ITT under Geneen, the marketing of pharmaceuticals, affirmative action, and bribery. As the 21st century breaks upon us, no ethical issues in business appear as significant as those being created by the rapidglobalization of business. Globalization has created numerous ethical problems for the manager of the multinational corporation. What does justice demand, for example, in the relations between a multinational and its host country, particularly when that country is less developed? Should human rights principles govern the relations between a multinational and the workers of a host country, and if so, which (...) principles are the correct ones? How should a multinational deal with a government in which corruption is rife? What are the ethical considerations involved in determining whether and how to transfer a risky technology to a country whose people may not be able to safely absorb that technology? Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

Algunos de sus integrantes buscan aplicar al cine los planteos de F. R. Leavis y la revista Scrutiny (...) a propósito de la crítica literaria. Es esta modulación analítica la que será puesta en cuestión con el auge del estructuralismo y el posestructurailsmo a los que se asocia la revista Screen en los años 70.: During the sixties, the journal Movie inherits from Cahiers du cinéma the preferencies for a politique des auteurs and for certain american films. However, never abandoning this tendency towards a “cinema of directors”, the british journal develops a rigorous method of formal analysis and detailed close readings. Some of its members try to apply to cinema the concepts elaborated by F. R. Leavis and the journal Scrutiny in reference to literary criticism. It is precisely this analytic method that will be questioned during the boom of structuralism and post structuralism to which the journal Screen will be asociated in the 70s. (shrink)

A “Critical Perspectives” article in the Journal of Bioethical Inquiry on scientific integrity in Brazil summarizes several misconduct cases documented therein . To further reinforce the responsible conduct of research in developing countries and to fight against the unaccountability of many editors , we describe here a Mexican instance of alleged in-house plagiarism .In June 2011, we submitted a “Correspondence” note to a Nature group journal to expose what we claimed to be a breach of collegiality and inappropriate authorship in (...) a three-page mutation report just published in that journal. Our main complaints were two: the surreptitious way in which we believed that both displayed metaphases in that report had been obtained from our files by a local colleague and then published without our consent and the massive easy-on co-authorship: 14 out of 21 co-authors declared just to have “provided clinical material.” In c .. El llamado “argumento maestro” de Berkeley, por el cual demuestra su principio _esse est percipi_, ha recibido críticas mixtas por parte de los comentaristas: algunos defienden su validez desde sus propias interpretaciones y otros lo acusan de falaz con base en diversas objeciones. El presente artículo defiende al argumento maestro de tres objeciones por parte de Russell, Pitcher y Tipton, las cuales son referidas como _“objeción de la confusión entre el acto perceptivo y el objeto percibido”, “objeción de la confusión (...) entre el concepto del objeto y el objeto mismo” y “objeción del solipsismo del presente”_. El autor propone su propia lectura del argumento maestro para evitar malentendidos y sostiene que dicho argumento cobra su verdadero sentido a partir de los siguientes puntos: la aclaración de los conceptos berkeleyanos de _idea y percepción_; la explicitación de la_ intencionalidad_ de la percepción en el sentido de su _dirección intencional_ hacia objetos intencionales (ideas); y la distinción entre los _dos niveles de dirección intencional de la percepción mediata_ (de una idea _por medio_ de otra), a saber: uno dirigido al _concepto o representación mental como su objeto intencional inmediato_ y el otro dirigido al _objeto representado_ como su _objeto intencional mediato_. I address three topics. First, I argue that the issue of corporate moral responsibility is an important one for business ethics.Second, I examine a core argument for the claim that the corporate organization is a separate moral agent and show it is based on anunnoticed but elementary mistake deriving from the fallacy of division. Third, I examine the assumptions collectivists make about whatit means to say that organizations act and that they act intentionally and show that these assumptions are mistaken (...) in their failure to understand the nature of intentional causality and of “as-if” intentionality. In exposing these mistakes I set out my own view in the form oftwo theses, the first of which states that individual members of an organization are always causally responsible for any corporate act,and the second of which states that attributions of intentions to corporations are always either descriptive or prescriptive attributionsof “as if” intentionality. Social media companies commonly design their platforms in a way that renders them addictive. Some governments have declared internet addiction a major public health concern, and the World Health Organization has characterized excessive internet use as a growing problem. Our article shows why scholars, policy makers, and the managers of social media companies should treat social media addiction as a serious moral problem. While the benefits of social media are not negligible, we argue that social media addiction raises unique ethical (...) concerns not raised by other, more familiar addictive products, such as alcohol and cigarettes. In particular, we argue that addicting users to social media is impermissible because it unjustifiably harms users in a way that is both demeaning and objectionably exploitative. Importantly, the attention-economy business model of social media companies strongly incentivizes them to perpetrate this wrongdoing. (shrink)

A systematic literature review was conducted on the production and publication of research articles related to the study of variables, financial technology (Fintech), and Bioeconomy. The purpose of this research was to know the main characteristics of the publications registered in the SD, WoS, and Scopus databases during the period 2007-2024, to February 8, 2024, achieving the identification of 46 publications in total. The information provided by these platforms was organized using graphs and figures, categorizing the information by CO-occurrence of (...) Keywords, Year of Publication, Country of Origin, and Area of Knowledge. Once these characteristics were described, a qualitative analysis was conducted to refer to the position of the different authors on the proposed topic. Among the main results of this research, Germany and the United States were the countries with the highest number of publications, with a total of 7 publications each, followed by Brazil with 6 publications, while 60% of the publications are concentrated and originate in European countries. The area of knowledge that contributed the most to the study variables was Environmental Sciences, with 18 articles. This systematic literature review allowed us to conclude that the study of the intersection of bioeconomy and financial technologies is an issue that is gaining attention. Pellegrino identifica que la medicina es una empresa moral, construida sobre ciertas creencias de lo bueno y lo malo, y presenta una caracterización del acto médico constituida por tres elementos: el hecho de la enfermedad, el acto de profesión y (...) el acto de medicina. En este artículo se evaluará las implicancias éticas del acto médico, en el marco de la Teoría del Reconocimiento de Honneth y el modelo tripartito de la relación médico paciente propuesta por Pellegrino. The phenomenal properties of conscious mental states happen to be exclusively accessible from the first-person perspective. Consequently, some philosophers consider their existence to be incompatible with materialist metaphysics. In this paper I criticise one particular argument that is based on the idea that for something to be real it must (at least in principle) be accessible from an intersubjective perspective. I argue that the exclusively subjective access to phenomenal contents can be explained by the very particular nature of the epistemological (...) relation holding between a subject and his own mental states. Accordingly, this subjectivity does not compel us to deny the possibility that phenomenal contents are ontologically objective properties. First, I present the general form of the argument that I will discuss. Second, I show that this argument makes use of a criterion of reality that is not applicable to the case of subjective experience. Third, I discuss a plausible objection and give an argument for rejecting observation models of self-knowledge of phenomenal contents. These models fall prey to the homunculus illusion. (shrink)

What is ethnicity and how does it inform the way we understand ethical and political issues involving ethnic change and ethnically conscious public policies? Jorge J. E. Gracia put forth what he calls his ‘Familial-Historical View’ of ethnicity in which Hispanic identity is understood in terms of history and family resemblances. He criticizes what he calls the ‘Common-Bundle View’ of ethnicity which understands ethnic belonging in terms of an essence. I defend two negative theses which lead to the outlines of (...) a positive thesis: (1) Gracia’s arguments against the Common-Bundle View are not effective; (2) the Familial-Historical View is inadequate because it downplays the essential role that cultural phenomena play in making Hispanic history ethnically relevant to Hispanic identity. As a way of building on the Common-Bundle View I sketch a reformulation that avoids Gracia’s criticisms and is more politically and ethically effective than his family resemblance view of ethnicity. What accounts for the apocalyptic angst that is now so clearly present among Americans who do not subscribe to any religious orthodoxy? Why do so many popular television shows, films, and music nourish themselves on this very angst? And why do so many artists—from Coldplay to Tori Amos to Tom Wolfe—feel compelled to give it expression? It is tempting to say that America’s fears and anxieties are understandable in the light of 9/11, the ongoing War on Terror, nuclear proliferation, and (...) the seemingly limitless capacity of science to continually challenge our conceptions of the universe and ourselves. Perhaps, too, American culture remains so permeated by Protestant Christianity that even avowed skeptics cannot pry themselves from its grip. In _A Consumer’s Guide to the Apocalypse,_ Eduardo Velásquez argues that these answers are too pat. Velásquez’s astonishing thesis is that when we peer into contemporary artists’ creative depiction of our sensibilities we discover that the antagonisms that fuel the current cultural wars stem from the same source. Enthusiastic religions and dogmatic science, the flourishing of scientific reason and the fascination with mystical darkness, cultural triumphalists and multicultural ideologues are all sustained by the same thing: a willful commitment to the basic tenets of the Enlightenment. Velásquez makes his point with insightful readings of the music of Coldplay, Tori Amos, and Dave Matthews and the fiction of Michael Frayn’s _Copenhagen,_ Chuck Palahniuk’s _Fight Club,_ and Tom Wolfe’s _I Am Charlotte Simmons._ Written with grace and humor, and directed toward the lay reader, _A Consumer’s Guide to the Apocalypse_ is a tour de force of cultural analysis. Este trabajo es una crítica al artículo del filósofo contemporáneo Jon Stewart, titulado: Borges and the Refutation of Idealism: A Study of «Tlön, Uqbar, Orbis Tertius». En dicho artículo se desarrolla una interpretación kantiana del cuento de Borges «Tlön, Uqbar, Orbis Tertius» como si fuera una refutación literaria de la filosofía de Berkeley, análoga a la supuesta refutación de la misma que Kant se adjudica. A este respecto, nos proponemos refutar cada una de las supuestas contradicciones e incoherencias que Stewart (...) identifica en la filosofía de Berkeley y, así, demostrar que el cuento de Borges no es una refutación de ella. The author sets out a realist defense of the claim that in the absence of an international enforcement agency, multinational corporations operating in a competitive international environment cannot be said to have a moral obligation to contribute to the international common good, provided that interactions are nonrepetitive and provided effective signals of agent reliability are not possible. Examples of international common goods that meet these conditions are support of the global ozone layer and avoidance of the global greenhouse effect. El libro "E-physicalism - A Physicalist Theory of Phenomenal Consciousness" presenta una teoría en el área de la metafísica de la conciencia fenomenal. Está basada en las convicciones de que la experiencia subjetiva -en el sentido de Nagel - es un fenómeno real, y de que alguna variante del fisicalismo debe ser verdadera.

En este artículo se presenta un análisis cualitativo preliminar de los contratos laborales firmados entre cuatro músicos de Europa del este y la dirección de la Orquesta Sinfónica de Antioquia en 1949, mientras dichos músicos estaban en los campos de refugiados europeos donde los sobrevivientes de la guerra fueron congregados para su atención y rehabilitación. Con este análisis se pretende problematizar la inserción de estos personajes como agentes de modernización cultural en Medellín, haciendo énfasis en las condiciones políticas y socioculturales (...) que caracterizaban a Colombia a comienzos de la década de 1950. La nacionalidad de estos músicos (tres checos y un rumano) era objeto de sospecha desde la legislación migratoria colombiana, que desde la década de 1920 establecía un catálogo de extranjeros que no debían entrar al país, pues podían traer ideologías contrarias a la defensa de la propiedad privada. Al contrastar estos contratos laborales con la política migratoria colombiana y con la responsabilidad pedagógica cívica que se le imponía a la actividad musical académica, se plantean algunas preguntas para debatir acerca de la narrativa oficial que presenta a estos músicos como agentes de modernidad importados e integrados a un proceso de modernización cuya representación se ha caracterizado por la ausencia de conflicto. This volume focuses on the westernized universities, in the US and abroad and examines the various dimensions of the education crisis and provides a sharper understanding of the crisis and the responses to the westernized university at multiple sites around the world.

The negotiations of the intergovernmental group known as the ‘IGWG’, undertaken by the Member States of the WHO, were the result of a deadlock in the World Health Assembly held in 2006 where the Member States of the WHO were unable to reach an agreement on what to do with the 60 recommendations in the report on ‘Public Health, Innovation and Intellectual Property Rights submitted to the Assembly in the same year by a group of experts designated by the Director (...) General of the WHO. The result of these negotiations was the ‘Global strategy and plan of action on public health, innovation and intellectual property’ which was approved by the World Health Assembly in 2008. The intention of the Global Strategy and Plan of Action (GSPOA) which was produced by the IGWG was to substantially reform the pharmaceuticals' research and development system in view of the findings that this system, whose purpose is to produce medicines for diseases which affect the greater part of the world population which lives in developing countries, had failed. The intellectual property rights imposed by the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and the recent trade agreements could become one of the main obstacles to access to medicines. The GSPOA makes a critical analysis of this reality, and opens the door to searching for new solutions to this problem. (shrink)

Joseph Carens in his 2013 book Ethics of Immigration argues we should not criminalize undocumented migrants. Instead, we should view them as irregular immigrants who are entitled to some general human rights. This article focuses on Caren's discussion of criminalization in light of recent scholarship by John Marquez and Natalie Cisneros pertaining to the Latina/o border death toll, generalized violence, and discourses on undocumented pregnant migrante females as multiplying rats and anchor babies. This article argues that simply relying on a (...) democratic state model to understand the realities of border militarization is not sufficient because it does not perform some of the explanatory functions performed by other non-ideal theories. By synthesizing the views of Cisneros and Marquez, this article distinguishs thick and thin senses of excessive border enforcement and outlines a notion of the racial/sexual state of expendability as a way of making better sense of these violent realities. Deeply rethinking the teaching of philosophy: problems and appropriationResumen: ¿Para qué sirve la filosofía? es la pregunta que se hace desde fuera de la comunidad filosófica y cuya respuesta puede abrir puertas o poner serios obstáculos a su consolidación como asignatura. El permanente cuestionamiento externo por la “falta de utilidad” y la constante labor apologética que genera, parecen ser un indicio de que la filosofía requiere innovación en algunos aspectos de su enseñanza. A fin de contribuir con este esfuerzo es (...) imprescindible identificar los problemas, y se determina que la falta de interacción con la ciencia puede ser uno de ellos. Se presentan dos ideas que se enlazan metodológicamente con este cambio de enfoque: una es poner el énfasis en los problemas filosóficos y no en autores; y la otra es facilitar que los estudiantes se apropien intelectualmente de la filosofía como elemento constitutivo de su pensamiento. Ambas ideas se implementarían sobre el trasfondo de establecer una relación estrecha con la ciencia, así como realizar cambios en la didáctica.: How is philosophy useful? is the question posed from outside the philosophical community and whose answer can either open doors or become a serious obstacle to its consolidation as a subject. The constant external questioning regarding its “lack of usefulness”, and the apologetic task it generates, seem to be an indication that philosophy requires innovation in some aspects of its teaching. In order to contribute to this effort it is essential to identify the problems, and it is determined that the lack of interaction with science may be one of them. Two ideas which are methodologically linked to this change of approach are presented: one is to underscore the philosophical problems and not the authors; and the other one is to enable the students to appropriate philosophy intellectually as a constitutive element of their thinking. Both ideas would be implemented on the basis of establishing a close relation with science, as well as making some changes in didactics.
